USCIS ANNOUNCES THAT H-1B VISA CAP MET FOR FY 2009

 

The U.S. Citizenship and Immigration Service (USCIS) recently announced that it has received enough H-1B visa petitions to meet the Congressionally-mandated cap for Fiscal Year (FY) 2009. The H-1B visa cap for FY 2009 is 65,000.

In addition to meeting the FY 2009 cap, the USCIS announced that it has received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the "advanced degree" exemption.

The USCIS will conduct the selection process for "advanced degree" exempt petitions first, followed by computer-generated random selection process for all cap-subject petitions received.

H-1B visas are issued for up to three years but may be extended to the maximum stay of six years.
